Key Requirements
Adds Health & Safety Code Chapter 2.13 (Sec. 1339.75). Any written or verbal patient communication about clinical information generated by GenAI must carry a disclaimer that it was AI-generated and give clear instructions for how the patient can reach a human health care provider. The disclaimer must appear prominently (start of written communication, throughout chat interactions, verbally at start of audio, throughout video). Communications read and reviewed by a licensed or certified human provider are exempt.

Enforced by the applicable state licensing/regulatory agency (Department of Public Health, Medical Board, etc.) under existing authority
