Key Requirements

Adds Business & Professions Code sections 4999.8-4999.9. It is unlawful for AI or generative AI to use terms, letters or titles implying that health information, advice or services are being delivered by a licensed health care professional when they are not, or to present itself as a natural person holding a board-regulated license. Licensees may not permit AI tools to imply licensed human care.

Regulated Parties

Any person, business or organization deploying AI (chatbots, telehealth platforms, websites, automated tools) that communicates health information; licensees of the healing arts boards

Enforcement

Each applicable healing arts board may enforce; violations treated as grounds for board action and as unlawful practice
