Key Requirements
Prohibits payers from using AI as the sole basis for an adverse determination of medical necessity — a licensed human must make the determination. Requires disclosure/reporting of AI use in utilization review to the Division of Insurance, the Department of Human Services and HCPF. Prohibits public and private payers from paying for psychotherapy services performed by an AI system.
