Key Requirements

Requires reasonable and technically feasible age assurance before users can access AI companions and establishes additional protections for children under 13, including parental consent and parental oversight of interactions. Authorizes the Attorney General to promulgate rules identifying acceptable age-assurance methods, considering platform size, resources, technical capability, cost and effectiveness of age determination techniques, audience, and prevalent industry practice.

Assembly bill status page shows passed Assembly and Senate, delivered to and signed by the Governor on 05/26/2026, enacted as Chapter 58. New York's separate 'Kids Chatbot Safety Act' (S 9051-B) passed both chambers in June 2026 but was awaiting the Governor's action as of this research (deadline December 31, 2026).
