Key Requirements

A mental health chatbot may not advertise products or services during a user interaction, may not sell or share individually identifiable health information or user input, and must clearly disclose that the user is interacting with AI and not a human — before the user's first interaction, at the user's request, and whenever the user asks whether AI is being used. Suppliers gain an affirmative defense if they file a written policy meeting statutory requirements with the Division of Consumer Protection.
