Key Requirements
Mental health professionals may use HIPAA-compliant AI tools, including software as a medical device, so long as they operate within their scope of practice and review and approve any mental health services provided. Prohibits any corporation or entity from providing, advertising or offering mental health services to the public, including through AI, unless the services are delivered by a mental health professional or are part of an IRB/privacy-board-approved study. Prohibited AI use constitutes unprofessional conduct.
